Terms of Use
These Terms govern access to and use of Kitezilla. By creating an account, submitting content or using listing-management features, you agree to these Terms. If you use Kitezilla on behalf of an organisation, you confirm that you are authorised to act for it.
1. The service
Kitezilla provides a directory and information service. Listings may be created by Kitezilla, submitted by third parties or managed by verified representatives. Publication does not mean that Kitezilla certifies, licences, inspects or endorses a provider, activity, instructor, location or offer.
Kitezilla is not a party to transactions made with listed providers. Availability, prices, safety standards, insurance, licences, cancellation terms and service quality must be confirmed directly with the provider.
2. Eligibility and accounts
You must be at least 16 years old, and have legal capacity under applicable law, to create an account. You must provide accurate information, protect your login credentials and promptly notify us of suspected misuse.
We may request verification before allowing a user to claim or manage a listing. Verification confirms only that we have accepted the evidence provided; it is not a general certification of the person or business.
3. User and business submissions
You retain ownership of content you submit. You grant the website operator a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, translate, adapt for layout and clarity, display and distribute that content for operating, promoting and improving Kitezilla. This licence continues for a reasonable period in backups and records after removal.
You confirm that:
- the information is accurate and not misleading;
- you have the rights and permissions required to submit text, images, logos and personal data;
- you are authorised to act for any organisation you claim to represent;
- the content complies with law and does not infringe third-party rights;
- commercial claims, qualifications and prices can be substantiated.
Do not submit unlawful, defamatory, discriminatory, deceptive, unsafe, infringing, malicious or irrelevant content, undisclosed advertising, fake reviews, copied descriptions, personal data without a lawful basis, or instructions encouraging dangerous conduct.
4. Editorial control
Kitezilla may review, edit, categorise, reject, suspend or remove listings and submissions. We may preserve editorial sections of a page, add transparency labels, combine duplicate listings or correct formatting and factual errors. Claiming a page does not transfer ownership of the page, URL, ranking, editorial commentary or directory data to the claimant.
We do not guarantee publication, placement, traffic, enquiries or continued availability. Search order may consider relevance, completeness, location, quality, freshness, commercial arrangements and other factors. Sponsored placement will be labelled where required.
5. Prohibited use
You may not:
- access accounts or systems without authorisation;
- scrape or systematically extract the directory to create or enrich another database, except as permitted by law;
- interfere with security, availability or normal operation;
- impersonate another person or misrepresent affiliation;
- submit fabricated ratings, reviews, locations or credentials;
- use Kitezilla to send spam or distribute malware;
- use content in a way that infringes intellectual-property or privacy rights.
6. Safety
Water and wind sports involve risks including injury, drowning, collision, equipment failure and rapidly changing weather. Directory information is general and may be incomplete or outdated. It is not a real-time forecast, safety assessment, navigation service or substitute for instruction and local knowledge.
Users are responsible for checking current weather, water conditions, access rules, hazards, rescue arrangements, insurance and equipment, and for choosing activities appropriate to their ability. See the Safety Disclaimer.
7. Affiliate links, advertisements and external services
Kitezilla may display advertising, sponsored placements and affiliate links, including links or tools operated through CJ and Stay22. We may receive compensation when users click, book or buy. Commercial relationships do not make Kitezilla the supplier or contracting party.
External services have their own prices, terms, cancellation rules and privacy practices. Review them before completing a transaction.
8. Intellectual property
Kitezilla and its original content, software, design and branding are protected by applicable intellectual-property laws. Limited personal, non-commercial use of publicly available pages is permitted. No other licence is granted except as expressly stated.
9. Content reports and enforcement
Reports can be submitted using the method described on the Contact page. We may request additional information, investigate, restrict visibility, remove content, suspend an account or take no action depending on the circumstances. Where required by applicable law, affected users will receive reasons and available options to contest a decision.
Repeated submission of clearly unlawful content, or repeated manifestly unfounded reports, may lead to temporary suspension after appropriate assessment and warning where required.
10. Availability and changes
We may change, suspend or discontinue features and update these Terms. We do not guarantee uninterrupted or error-free access. Material changes will be communicated where required.
11. Disclaimer and liability
To the maximum extent permitted by law, Kitezilla is provided on an “as available” basis without a guarantee that listings, forecasts, links, prices or other information are complete, accurate or current.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for intentional misconduct or other mandatory protections. Subject to that limitation, the operator is not responsible for third-party services, decisions made solely in reliance on directory information, or indirect or consequential loss arising from use of the service.
12. Indemnity for business users
To the extent permitted by law, a business or professional user agrees to compensate the operator for third-party claims and reasonable costs arising from content it submitted, its infringement of rights, or its material breach of these Terms. This section does not apply where the operator caused the claim or where mandatory law provides otherwise.
13. Governing law and disputes
These Terms are governed by the laws of Europe, without depriving consumers of mandatory protections available under the law of their habitual residence.
